Digital Constitutionalism Sebagai Kerangka Tata Kelola Digital Panda Bond Indonesia: Perspektif Transparansi, Akuntabilitas, dan Perlindungan Hak Konstitusional

Abstract

Perkembangan digitalisasi keuangan publik telah mengubah tata kelola pembiayaan negara, termasuk pengelolaan instrumen Panda Bond, yang kini tidak lagi sekadar berfungsi sebagai instrumen utang, tetapi juga sebagai bagian dari ekosistem digital financial governance. Penelitian ini bertujuan menganalisis bagaimana konsep Digital Constitutionalism dapat menjadi kerangka normatif dalam tata kelola Panda Bond di Indonesia, serta mengkaji penerapan prinsip transparansi, akuntabilitas, dan perlindungan hak konstitusional dalam pengelolaan instrumen tersebut. Metode penelitian ini mengunakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Bahan hukum diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, doktrin hukum, serta literatur ilmiah mengenai Digital Constitutionalism, tata kelola keuangan digital, dan Panda Bond. Hasil penelitian menunjukkan bahwa digitalisasi seluruh siklus pengelolaan Panda Bond, mulai dari penerbitan, registrasi, penyelesaian transaksi, hingga pelaporan, menimbulkan implikasi konstitusional yang memerlukan penguatan prinsip rule of law di ruang digital. Konsep Digital Constitutionalism memberikan landasan normatif untuk memastikan bahwa tata kelola Panda Bond memenuhi prinsip transparansi, akuntabilitas, perlindungan data, partisipasi publik, dan penghormatan terhadap hak konstitusional warga negara. Penelitian ini menawarkan model Constitutional Digital Public Debt Governance sebagai konstruksi hukum baru yang mengintegrasikan prinsip-prinsip konstitusional ke dalam tata kelola digital pembiayaan negara. Model tersebut diharapkan menjadi dasar pengembangan regulasi pembiayaan negara berbasis teknologi yang adaptif, akuntabel, dan selaras dengan nilai-nilai konstitusi Indonesia.
